The nature of a wrongful death case

A wrongful death claim is one that the family of a deceased has the right to bring when a loved one is killed as a result of the negligence, gross negligence, recklessness or other violation of law or established obligation of some other party or individual. When a wrongful death case must be filed

Under Connecticut state law, a wrongful death action must be filed within two years of the date the injury occurred or two years of when the injured passed away. Compliance with these laws are strict. If settlement is not reached with the responsible parties, suit must be filed within this time period or the right to recovery is barred.

Who brings the case?

Either the executor of the deceased person’s will or the administrator of the estate may bring the case. In the event of the death of a minor child, the parents may be the proper party to bring a wrongful death case. They may have the right to recovery and, therefore, have the responsibility to initiate the case.
